The National Tourism Agency has planned to produce a documentary, with the objective of "Realizing a documentary to promote Albania worldwide, on tourist, cultural and historical destinations, in international media".
In accordance with article 7, point 1/b, of law no. 162/2020 “On public procurement”, of the Council of Ministers No. 1195, dated 05.08.2008 “On the purchase, development, production and co-production of programs or advertisements for broadcasting by radio and television operators or publication in the written media and for contracts, for broadcasting time, by state administration bodies”, of the normative act No. 12, dated 29.07.2022, “On some amendments and additions to Law No. 115/2021, “On the 2022 budget”, as amended and the Council of Ministers No. 298, dated 20.04.2016 “On the organization and functioning of the National Tourism Agency”, the National Tourism Agency has planned to develop the procedure “Realization of a documentary for the promotion of Albania worldwide, on tourist, cultural and historical destinations in international media”.
Object: "Realization of a documentary to promote Albania worldwide, on tourist, cultural and historical destinations, in international media."
Need for performing this service: Promoting Albania worldwide, through the production of a television documentary on Albania's tourist, cultural and historical destinations, which will be broadcast in international media.
Frequency of documentary screening: 1 (one) time in international media
Implementation period: 10 weeks from the conclusion of the contract
Defined limit fund: 34,832,731 (thirty-four million eight hundred thirty-two thousand seven hundred thirty-one lekë, (excluding VAT).
The deadline for submitting confirmations from print media is until on 04.10.2022, 12.00, at the National Tourism Agency.
Confirmations on the continuation of negotiations: Confirmations must all arrive on a single day, sealed in a non-transparent envelope, signed and stamped with the name and address of the entity and marked "Do not open" except in cases where the bid evaluation committee is present and not before the date 04.10.2022, 12.00.
Otherwise, they will be rejected and returned unopened.

TERMS OF REFERENCE:
Purpose
Promoting Albania worldwide, through the production of a television documentary on Albania's tourist, cultural and historical destinations, which will be broadcast in international media.
- Conception and writing of a television documentary in Albania by an international storyteller/presenter with experience in the required field.
- Filming and production of television documentaries in Albania, by a staff with experience in supervising the production of documentaries, films, series, etc.
- Editing and post-production of the television documentary for Albania, by a staff with experience in supervising the production of documentaries, films, series, etc.
- Broadcasting the documentary in a foreign media outlet on international television.
- The Economic Operator (EO)/Subject must submit and then broadcast 1 television documentary to international media with the following specifications:
- Length 45 minutes
- Full HD quality
- 4K quality
- Professional Voice Over
- In English
- The Economic Operator (EO)/Subject must submit 10 minutes of footage extracted from the final documentary, for use by the National Tourism Agency (NTA) on its website/social media channels in clips (no more than 2 minutes each).
- The Economic Operator (EO)/Subject must submit 10 minutes of selected general footage for use by AKT on its website and in promotional campaigns.
- The Economic Operator (EO)/Subject must submit 5 Behind the Scenes clips of the crew at work for use by AKT on its website and in promotional campaigns.
- The Economic Operator (EO)/Subject must submit 10 publicity photos of the crew at work, during the filming of the documentary, for use by AKT on its website and in promotional campaigns.
The documentary should reflect attractive and authentic tourist destinations of Albania from north to south, as well as cultural and archaeological heritage landscapes, cultural monuments and isopolyphony.

SPECIFIC INFORMATION AND REQUIREMENTS RELATED TO THE ECONOMIC OPERATOR
- GENERAL ADMISSION/QUALIFICATION CRITERIA
Legal documentation that must be submitted as a qualifying criterion:
1. Documents proving that the operator/bidder:
i. It is a company registered in its country of registration.
ii. It is not in bankruptcy or liquidation process.
iii. Average annual turnover for the last three years not less than 40% of the contract value.
2. SPECIAL QUALIFICATION CRITERIA
2.1 The operator/bidder must submit:
Declaration of conformity with technical specifications. (Annex 1)
Conflict of interest declaration. (Annex 2)
2.2 Technical capacity:
a) The Operator/Bidder must declare a proven track record in all required areas of its activity in the last five years.
b) The Operator/Bidder must declare a list of contracts (completed or ongoing), specifying the subject matter of the contract, date and duration.
c) The Operator/Bidder must declare at least 1 (one) contract for similar services with a value of not less than 40% of the budgeted contract.
d) The Operator/Bidder must declare that it has on its staff or will contract for the implementation of the contract six key experts with the following experience:
Number of experts: 5 experts
Leading expert 1 – Senior TV presenter/historical expert, with 10+ years of experience in History Publishing and Broadcast Communications.
Leading expert 2 – Series producer with 10+ years of experience overseeing the production of world-class films and series and documentaries for international distribution.
Leading expert 3 – Director of Photography with 10+ years of experience in filming films, series and documentaries.
Leading expert 4 – Head of Production/Film Director/Producer with 10+ years of experience in producing first-class films and series, documentaries and screenplays.
Leading expert 5 – Line Producer with 10+ years in television production management for first-class content for distribution.
For the above experts, CVs and/or qualification certificates/professional licenses must be submitted.
The Operator/Bidder may propose other experts it deems necessary for the completion of the services.
In any case, the contracting authority has the right to carry out the necessary verifications on the authenticity of the information declared by the Economic Operator as above.
3. The Economic Offer Form must include:
- Program outline for the documentary
- Production schedule;
- Distribution/transmission plan
4. Declaration of compliance with technical specifications. (Annex 1)
5. Declaration of conflict of interest. (Annex 2)
6. Bank certificate (IBAN).
All documents must be originals or notarized copies issued no later than 3 (three) months from the date of tender opening. Cases of failure to submit a document, or of false and inaccurate documents, are considered conditions for disqualification.
The deadline for the implementation of the service will be according to the requirements of the contracting authority, starting from the signing of the contract and according to the technical specifications in the Invitation for Negotiations.
In its bid, the bidder must provide full contact details.
The selection of offers will be made according to points no. 7 and 12 of the Council of Ministers No. 1195 dated 05.08.2008.
Evaluation Criteria:
• Previous experience and legal documentation submitted by the mass media body
• Staff/personnel that will be engaged in the implementation of the service
• Lowest price offered by the media outlet
Technical legal documentation is evaluated with 50 points. presented, as follows:
– 30 points of previous experience and legal documentation submitted by the mass media body;
– 20 points for staff/personnel that will be engaged in providing the service.
The operator's lowest economic offer is evaluated with 50 points.The economic offer will be presented in lek excluding VAT.
The economic offer will be presented in Lek/Euro, excluding VAT.
Note: The foreign currency valuation will be made according to the official exchange rate of the Bank of Albania on the date of bid opening.
Bidders have the right to participate in the bid opening process, as representatives or authorized persons.
Offers must be sealed in an envelope, closed and will be submitted by company representatives officially to the National Tourism Agency, Protocol Office.
The Commission will not accept any bid submitted after the deadline and not in accordance with the above requirements.

About conflict of interest

Conflict of interest is the state of conflict between public obligations and private interests in an official, if he has a private interest, if he is directed by an influential director, can influence the performance of his public duties and obligations.
Pursuant to Article 21, point 1 of Law No. 9367, dated 07.04.2005, the categories of officials defined in Chapter III, Section II, who are absolutely prohibited from benefiting directly or indirectly from the conclusion of contracts with a party in a public institution are:

For mid-level management officials, according to Article 31, and for officials provided for in Article 32 of Chapter III, point 2, of this law, the prohibition according to point 1 of this article, due to the private interests of the official, defined in this point, applies only to the conclusion of contracts in the area of the territory and jurisdiction of the institution where the official works. This prohibition also applies when the party is a subordinate institution.
When the official is in the function of the mayor or deputy mayor of the municipality, the council of the commune or the region, a member of the relevant council or is a senior official of the local government unit, the prohibition on private interests of the official, set out in this point, applies only to the conclusion of contracts, as the case may be, with the council of the municipality, commune or region, where the official exercises these functions. This prohibition also applies when the party to the contract is a public institution, dependent on this unit (Article 21, point 2 of Law No. 9367, dated 07.04.2005).
